These terms govern your use of Their First Song, operated by Modia LLC. By placing an order, you agree to them.

The service

Their First Song creates a personalized, AI-produced song for a child based on the details you provide. Each song is generated for your order.

Orders and pricing

Prices are shown on the site at checkout in US dollars and may change over time. Payment is due at purchase and is processed securely by Stripe.

Delivery

We aim to deliver each song to your email within one hour of purchase. Most arrive sooner. If anything delays your order, we will let you know.

Your song and how you can use it

Your personalized song is for your personal, non-commercial use (enjoying, sharing with family and friends, and keeping as a keepsake). Songs are generated with AI music tools; we do not guarantee that any song is wholly unique or eligible for separate copyright registration.

Refunds and revisions

We want you to love the song. If it is not right, contact us and we will revise it or provide a refund. Reach out within a reasonable time after delivery.

Acceptable use

Do not submit content that is unlawful, hateful, or infringing, or request a song that targets or harasses anyone. We may decline or cancel any order at our discretion and issue a refund.

Disclaimers and liability

The service is provided "as is." To the fullest extent permitted by law, Modia LLC is not liable for indirect or consequential damages, and our total liability for any order is limited to the amount you paid for it.

Changes

We may update these terms from time to time. The current version is always posted here.
